The step by step guide to dealing with Jamie Baillie

Summary and purpose

This guide is meant as a neutral and rational guide to dealing with attacks by one Jamie Baillie of Toronto, London or Sarnia, Ontario, Canada, owner of the domain, darkshado.ca. (He has moved within a 500 km radius frequently. He is currently believed to reside either in Sarnia, Ontario or has moved to the province of Alberta)

Chances are good that if you've run into Mr Baillie, you are a victim of one of his many LARTs (Luser Attitude Readjustment Tool), or complaints to your ISP or web host to have your connectivity removed, your website shut down or both.

Mr Baillie is well known for sending many, often dozens, of emails off to each and every contact he can find not only within the domain name of his current target, but their upstream providers, as well. He does not restrict himself to role accounts such as abuse@ or postmaster@, he will hunt down the names and email addresses of executives of his target and email them, as well.

Mr Baillie's goal appears to be to silence anyone he disagrees with. He will often contradict himself (many times, within the same sentence) or accuse others of actions that he himself is guilty of doing. When someone points out his inconsistencies or double standards, Mr Baillie resorts to absolutely foul language, threats of violence, threats to have the person removed from the Internet and threats of legal action.

It is important to remember that Mr Baillie has never followed through with any of his threats, other than to bombard ISPs and web hosts with his complaints.

Perhaps more important to remember is this: It is easier and simpler to ignore and/or killfile (Killfile: To automatically filter any messages from/about him from your news/email reader so you do not see them) Mr Baille. Responding to or dialoguing with Mr Baillie is not a productive use of time and does nothing but add to the general "clutter" of the Internet.

Jamie Baillie Tactics

Here are Mr Baillie's most common tactics and courses of action when he comes across someone he disagrees with:

  • Send multiple complaint emails to his targets' ISP and web provider - Often sending to every public address he can find.
  • A foul mouthed diatribe in Usenet, cussing at his target, wishing them to die, or referring to them as prostitutes and use of sexist or racist remarks.
    (He uses terms like "whore", "prostitute", "KKK", "Nazi" and several other terms not suited in a document intended for a general audience)
  • Threats of death and bodily injury to anyone who dares come near him
  • Telephone calls and emails to his targets' employers
  • Threats of legal action against both his targets and his targets' hosting providers and their upstream providers.
  • Posting of personal information about his targets' families, such as their aging and sick parents.
  • He will label you a criminal, despite not fully understanding how one is actually labelled a criminal in any democratic and law-abiding society.
    (Perhaps ironically, often the actions he labels his victims as 'criminals' for, Mr Baillie is well documented for doing that very thing)
  • He continually insists that he is "defending his good name" - Yet he does so with absolutely foul language, threats of violence, threats of legal action, threats of silencing via disconnection from the Internet, Usenet and/or webhosting.
  • Jamie Baillie is now posting anonymously, under the pseudonym "The Usenet" - This, after years of constantly attacking people for "not using their real name" in usenet. Hypocritically, he will accuse people of being cowards for not posting using their real names, despite the fact that he posts as "The Usenet" and uses anonymous proxies and free email accounts to hide himself. (Here is an example of him telling someone they don't have the **lls to post using their real name and real email address; He is posting as "The Usenet", theusenet@mail.com)
  • Make complaints to the police department in the jurisdiction of his targets' web hosts. He made a complaint to the Chatham-Kent police about this site (Hosted on CanadianISP.ca) in June of 2010; After speaking with the police officer, he informed Mr Baillie that his issues with this site are civil, not criminal, and he should retain counsel to pursue the issue in court.
    To this day, Mr Baillie continues to call Marc Bissonnette a criminal, despite him being informed directly by law enforcement that Mr Bissonnette is not performing any criminal acts.
  • Threatens to have citizens of various countries extradited to Canada for prosecution for "criminal libel and harasement (sic) - Despite numerous requests, he can not provide a single example of a foreign (to Canada) national being extradited to Canada for internet-based disagreements. Not only has Mr Baillie failed to show a single example of this ever happening in the recorded history of mankind, but continues to make the threat, despite its level of extreme ludicrousness.

If you are an ISP, NSP (News Service Provider) or Web host

If you are contacted by Mr Baillie, your best course of action is to ignore him. Filter any and all communications from him or his aliases to /dev/null or advise him to have his legal counsel (he has none) to contact your own.
Mr Baillie will not cease contacting you until you have terminated your paying customer. His sole purpose in contacting you, over and over and over again is to silence those he disagrees with.

By all means, feel free to investigate his initial allegation on the off-chance that he is reporting something legitimate, but remember to look at the entire context. Chances are good that he is complaining about something your customer wrote in Usenet. Usenet can get inflammatory at times, to be sure, but when dealing with Mr Baillie, one has only to look at an entire thread to reveal that it is more often than not Mr Baillie being abusive, inflammatory, threatening and disruptive.

Remember that, as a business, the public/customer relations impact on you can be extremely negative if it is widely known that you silence paying, law-abiding customers based solely on the complaint of a single individual (no matter how many times that individual repeats the same complaint) - Most democratic countries have a legal system with due process - Mr Baillie seeks to circumvent that process by making himself sound more threatening than he really is.
It is most important to remember that he has threatened hundreds of ISPs, NSPs and web hosts with legal action: to date, he has launched exactly zero actions, no matter how threatening his words or posturing has been.

If you are the target of Jamie Baillie attempts to get you disconnected or silenced

  1. Contact your ISP and/or web host and explain your side of the situation. Ask them to take 30 seconds and type in "jamie baillie" into google and see what comes up. This alone should tell the ISP/Host who they're dealing with in regards to Mr Baillie.
  2. Do not respond to Jamie Baillie in public. (Yes, this author is guilty of not following this rule) - He absolutely will not respond to logic, experts or even documented evidence of his own actions.
  3. If your employer has been targeted by Mr Baillie, follow the same steps: Show them a google search for his name and they will see who it is that is making complaints.
  4. Document, document, document. While Mr Baillie will deny his actions, a court will not, should you pursue a restraining order or a libel action. Remember, however, your own actions will be looked at, so remember rule #2 above.
  5. Contact Mr Baillie's ISP and:
    • His News Service Provider (NSP) if the harassment is via Usenet
    • His web host provider if the harassment is via his website(s) (ex: defamatory or libelous pages about you or your company)
    • Law enforcement in both your jurisdiction and his if threats of violence are being made

If you have found yourself blocked via Spamhaus, UCEProtect, APEWS or another block list - beware of replies.

  • Some block list providers will suggest that you discuss your case in the Usenet newsgroup news.admin.net-abuse.email in order to learn how to get yourself de-listed. There are quite a few very smart individuals who will give you sound advice on cleaning up your network, changing business practices or moving your services to a non spam-friendly ISP. Mr Baillie, however, often takes it upon himself to belittle such people, telling them that they are spamming the newsgroups, so on and so forth. Your best bet is rule #2 above; Do not reply to him and ignore his content.
  • Mr Baillie will claim that he is a spam fighter, yet he has been listed himself in the Spamhaus RBL five times, UCEProtect eight times and APEWS seventeen times (plus a specific FAQ entry for APEWS) for his activities. You should ask yourself if you want to be taking advice from someone listed five times by one of the most well known and respected RBLs on the Internet. (His most recent Spamhaus listing is here)

  • While Mr Baillie claims he is a spam fighter, he is the only person in existance known to constantly fight and harass other spam fighters - No other person who considers themselves as actively anti-spam spends as much time harassing, libeling and threatening anti-spammers. It makes one question where Mr Baillie's true sympathies lie - the anti-spammers or... the spammers ? To date, Mr Baillie has done more to help spammers than hinder them by making the lives of anti spam network admins and activists difficult.

Attempts to help Mr Baillie / Give a second chance

There have been a few times, over the years, when someone new comes into the newsgroup, NANAE, sees much of the vitriol between Mr Baillie and his detractors (or detractees) and thinks / suggests Mr Baillie may be being picked on. I did this at one time myself. Some people have gone the extra step by providing him web and/or web hosting, thinking that all Mr Baillie needs is a fair chance.

With each and every person who has done this - without exception, Mr Baillie has turned around and 'bitten them in the rear', so to speak. Even Claus Von Wolfhausen, of UCEProtect, hosted Mr Baillies' mail servers at one time, thinking to help him out. As you can see below, Mr Baillie is now listed 8 times for abuse at UCEProtect.

I myself made a genuine attempt to show Mr Baillie how he could repair his reputation, as this is often his excuse for his continual abuse "I am defending my good name" and wrote a guide for repairing your reputation on the Internet. Mr Baillie followed this advice for three days before breaking it by replying to a female member of the newsgroup and calling her a name that I shall not reprint here.

Sanctions to date against Jamie Baillie

Jamie Baillie has been harassing and threatening literally hundreds of people for well over a decade (it is 2010 as this is being written). While it may seem as if he is doing this with impunity, he has been castigated multiple times:
  • Trouble with law enforcement with regards to releasing documents relating to the Karla Homolka trial while it was under a publication ban. Charges avoided due to crown attorney feeling he was 'troubled' and misguided.

  • Jamie Baillie is specifically mentioned in the APEWS FAQ as an abusive user, for his disruptions in the newsgroup news.admin.net-abuse.email
  • Jamie Baillie has been cut off from several news providers, the most recent being 2010-04-26, for abuse of terms/abuse of service
  • Jamie Baillie has had service terminated from at least one ISP (rogers.com) for abuse of terms/abuse of service
  • Jamie Baillie has had his web site hosting terminated from numerous hosting providers for abuse of their terms of service, as well as posting libelous and harassing information on his site.
  • Jamie Baillies' latest host, Datona.com, suspended terminated (details at old host in link) his site for libelous and harassing content - May 19th, 2010
    His hosting with Datona lasted exactly 10 days.
  • Jamie Baillie's latest host (Aug, 2010), Netelligent terminated his account for abuse. - Aug 14, 2010
  • Jamie Baillie's latest,latest host (Aug, 2010 - He didn't even last a month), NetDirekt(A Gernan web host) terminated his account for abuse. - Aug 26, 2010
  • Jamie Baillie's managed to convince NetDirekt to re-instate his hosting on Agu 27, 2010 - They cancelled him ONE DAY later, on August 28th. Terminated his account for abuse. - Aug 28, 2010
  • Jamie Baillie's latest webhost, HostBig.net, is not only a known spam and scam supporter, based out of Holland (Conveniently to shield Mr Baillie from Libel laws - or rather -It shields his *host* from libel laws), but hostbig.net is so deeply welded into both Spamhaus and AHBL.org that the only people Jamie Baillie will be able to send mail to is other spammers like him.
    Update: Due to several complaints, both legal and through private channels, it appears as if not only has Jamie lost his hosting at hostbig.net, but that HostBig itself has been shut down. As one NANAE regular put it: "Looks like www.hostbig.net is now owned by a domain squatter.
    They're out of business.
    Once again, choosing to host [Baillies' website] ends up with the entire provider getting nuked from high orbit."
  • Jamie Baillie had his account terminated with Google Apps for violation of terms of service and abuse. Termination notice here.
  • Jamie Baille was terminated by Rogers Cable from Internet access for Acceptable Use Policy violations.

    Steve Linford of Spamhaus, posting the proof from Rogers Cable themselves that they had terminated Jamie Baillies' Internet access.
  • It is believed, though not confirmed, that Jamie Baillie has moved out of province, due to the sheer number of people he has angered over the years, resulting in credible threats to his safety.
    Despite being told by authorities to "tone it down" and stop antagonizing people, he continues to do so, though anonymously. Unfortunately, his terrible spelling and grammar are identifiable enough that even posting under a pseudonym does not protect him from being held accountable for his own actions.
    NOTE: This is not to suggest that anyone should use anything but legal means to find recourse with Mr Baillie; However, his actions are evidence that when one spends so many years antagonizing so many people, one runs the risk of a victim 'taking the law into their own hands'.

While this document is not intended to ridicule Mr Baillie, one must suspect both his motives, as well as his intent, given he has been nominated for - and elected winner of, so many Kook of the Month awards - These awards are usually given to people for behaviours that are so odd, off the wall, disruptive or just plain illogical, that one almost wonders if they are intentionally trying to win them. This document was written by me, Marc Bissonnnette, of CanadianISP.com in response to Mr Baillie's years of abuse of process. The final straw, of course, was Mr Baillie hosting a page on his site asserting that I am a criminal and suggesting that no one do business with me or my companies.

Mr Baillie will, of course, begin to contact my upstream provider and their upstream providers in an attempt to silence me, have my hosting and connectivity removed and to generally make a nuicance of himself. I happen to know that TekSavvy, the company hosting this server, is a fine company who respects their customers and does not appreciate people wasting their time with frivolous or abuse of process.
